Acceptance Of The Project Prior To A Project’s Commencement:
Acceptance of the project a quote outlining the nature of the work to be done, an estimated time frame for completion, and our fees will be given to you prior to the commencement of a project.
Terms & Conditions For Payment Of Web Design Services:
Remittance you will receive an invoice for 50% of the quoted charges as soon as you accept the quotation. We will not begin working on your project until we have received this sum, which is non-refundable. A final invoice for the remaining 50% of the job, along with any fees for any extra work we did, will be given to you after it is finished. Until we receive this last payment, we won’t release any work to you or allow your website to launch.
Policy For Refunds:
If you made an upfront payment, you are eligible for a 100% refund in the following situations:
- We either didn’t begin your project at all or couldn’t get started right away.
- You have 24 hours after completing the payment to cancel the project.
- I made a mistake and paid more.
There will be no reimbursement if:
- The design mockup has already received your approval. If we are unable to finish the project according to the project’s standards, this condition won’t apply.
- The reason for the project delays is your poor communication.
- Delay in Work
- Rejection of Work
- Technical Issues
Submission On Search Engines Input:
We do not promise that your website will appear in a particular position in search engine results. In accordance with current best practices, we carry out basic search engine optimisation.
Backups:
You are in charge of keeping your own backups for your website, and we won’t be held accountable for recovering any customer data or websites unless the loss of data results from our own carelessness.
Online Business:
You are in charge of adhering to all applicable e-commerce laws, and to the greatest extent allowed by law, you will defend, indemnify, and hold harmless PGWEBTECHY and its subcontractors from any claim, penalty, tax, tariff loss, or damage resulting from your or your clients’ use of Internet e-commerce.
Practice:
Depending on the client’s requirement, our knowledgeable staff would serve as the client’s team’s online trainer.
Initiative-related Delays:
PGWEBTECHY shall not be expected to meet the timescales specified in the quote if the client’s delays in supplying the necessary feedback, information, or data to complete the project are unreasonable. The client gives PGWEBTECHY permission to forfeit, fine, or penalise any payments paid for this project if requested details, data, or information are not provided within 15 working days.
The client agrees that the project and services will be considered received and accepted by the client if, during the project duration, they do not communicate with PGWEBTECHY for more than 30 calendar days. The client also gives PGWEBTECHY permission to mark the project as completed and charge the client the remaining amount that has not been invoiced in accordance with the agreed-upon total project price.
Nonetheless, the client may direct PGWEBTECHY to halt the project if they provide:
The “on-hold” period is limited to two calendar months.
The client acknowledges that the project team structure and the professionals involved may alter from what was first agreed upon.
Every time a project is placed “on-hold,” the client consents to pay this project resuming cost.
Project Termination:
PGWEBTECHY will not be held to the timescales specified in the quote if the customer exhibits unreasonable delays in delivering the necessary data, information, or feedback to complete the project. Project Closed if the client fails to keep in touch with PGWEBTECHY for more than ninety calendar days during the project’s length. If the client is not satisfied with the third design iteration, the project is terminated.
Delay In Domain/ Hosting Payment:
The client’s domain and hosting will expire if they are unable to pay the renewal fees on time. Additionally, the client is subject to a late fee charge if they wish to renew their expired name and hosting.
Data, files, and databases that are lost are not our responsibility. The hosting payment must be made in full plus a late fee if a client needs access to the files on the suspended account.
4 Months Of Complimentary Technical Assistance: PGWEBTECHY provides free support for 4 months. The client might select our maintenance package after 4 months.
Maintenance Of The Website:
After the website is online, the following services will be paid separately unless otherwise specified in writing:
- Content updation;
- Improvements and rational changes to the website that the customer had not previously planned or approved;
- Updates to the design and content presentation that the client had not previously planned or approved.
Content and Data Entry:
The client is ultimately in charge of giving the development team relevant content free from copyright concerns. In order to prevent any delays, all content should be delivered within the allotted time. Any spelling or grammar errors will not be the responsibility of our organisation.
Pictures/ Images:
It is the client’s overall duty to supply the development team with suitable photos and images free from copyright concerns. To avoid any delays, all of the graphics should be sent within the allotted period. Our business will not assume any liability for problems with photo theft.
Third Party Add-ons, Applications, and Extensions:
Prior to the project commencing, the client is responsible for covering all third-party expenses related to domain name registration, hosting, and the acquisition of third-party utilities and services. Here are some instances of third-party fees:
- Hosting Fees for Server Space
- SSL certifications
- Services for backup
- Any third-party APIs that the “Client” requests be integrated with the work ordered.
- Any third-party plugins, scripts, applications, software, widgets, or services that the “Client” mandates be incorporated into the work requested.
- Sign-up and recurring fees for payment gateways
Legal Section:
Even though you have warned us of the possibility of such damages, we cannot guarantee that the functions within any web page (or part of your website design) will always be error-free. As a result, we will not be held in any way responsible for any third-party damages, including lost profits, lost savings, or other incidental, consequential, or special damages arising out of the operation of this website and any other web pages.
Content Management Systems:
- A Content Management System (CMS) will be used in the development of every item except for our entry-level package (Start Up).
- The company now only uses the WordPress Platform as our CMS of choice in order to preserve customer compatibility. Various management systems are used by e-commerce companies, depending on the project’s complexity and size.
- Nevertheless, depending on the precise needs of the project, the business might occasionally create a custom solution.
- Your selected plan includes coverage for any related or extra costs, including setup, testing, installation, and introductory training related to content management systems or e-commerce management systems.
General:
- A website will not launch until a standing order or basic payment has been set up, unless special agreement has been reached in advance.
- Additional costs for extra features and/or additional design costs, not covered by our standard packages, will be agreed and invoiced before the website goes live.
- If the Client does not respond to the Company’s request to discuss or choose ongoing support options, the client will automatically be placed on what the company feels is the most appropriate support package.
- A small admin fee is payable for switching the client to another hosting provider.
- There may be an additional fees for any design changes requested after the initial agreed design has been signed off.
- The Company is not responsible for writing or inputting any text copy unless this has been specified by the client.
- If you are hosting the website elsewhere, the Company cannot guarantee that the website is fully compatible with all hosting provider’s server operating systems, especially any contact forms, Content Management Systems, database driven websites, etc.
- The company do not offer any technical support for any other web site hosting company that you may choose (if you elect not to host the website with us).
- If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. Just the same as a fine, you cannot transfer this contract to anyone else without our consent or permission.
Changes to These Terms and Conditions:
PGWEBTECHY reserve the right to add, delete, or modify any provision of these ‘Web Design Terms and Agreement’ at any time without notice.
Failure to receive notification of a change does not make those changes invalid. These Terms and Conditions will always be available to download or print from our website.
